Senate to vote on Clarity Act as crypto industry intensifies lobbying

Key Takeaways

  • Senate to vote on Clarity Act for crypto regulation Tuesday
  • Bill needs 60 votes, including seven Democrats, to pass
  • Opposition cites consumer protection and stablecoin concerns
  • White House supports the bill, emphasizing U.S. innovation leadership

The U. S. Senate is gearing up for a critical vote on the Clarity Act this Tuesday. This bill seeks to create a regulatory framework for cryptocurrencies and digital assets, but its path forward is uncertain. To pass, it needs 60 votes, meaning at least seven Democrats must cross the aisle to break a potential filibuster.

Since clearing the Senate Banking Committee in May, the Clarity Act has faced intense lobbying from both banks and the cryptocurrency industry. Banks are worried about stablecoin interest payments leading to a potential deposit flight. Meanwhile, Democrats are pushing for stronger ethics provisions to prevent individuals like former President Donald Trump from financially benefiting from crypto ventures.

Senate Majority Leader John Thune, R-S. D., has set the stage for a preliminary vote, describing it as a 'free vote' to keep the bill alive for further amendments. Supporters of the bill, including Sen. Cynthia Lummis, R-Wyo., believe the bipartisan process has resulted in a well-balanced piece of legislation. Lummis expressed optimism about the bill's prospects.

However, the opposition is formidable. Sen. Chris Van Hollen, D-Md., has criticized the bill, arguing it pretends to protect consumers while leaving significant issues unresolved. Van Hollen expressed strong opposition to the bill.

In response to Democratic concerns, Republican leaders have revised the bill to include a crypto ethics agreement and a compromise on stablecoin yields. The updated draft allows state attorneys general to enforce ethics requirements on federal officials and instructs the Treasury secretary to limit stablecoin rewards if there's a significant deposit flight.

Despite these revisions, the bill's future hangs in the balance. A Democratic aide suggested that enough Democrats might back the preliminary vote to keep the bill in play, with the White House indicating a willingness to make further concessions if the vote is successful.

Sen. Bernie Moreno, R-Ohio, highlighted that Tuesday's vote isn't the final say but a step towards ending debate on digital asset regulation. Moreno emphasized the opportunity for amendments after the vote.

The White House has shown support for the Clarity Act, underscoring the importance of U. S. leadership in innovation. The White House press office reiterated the President's support for the bill.

Crypto industry figures, like Coinbase CEO Brian Armstrong, are hopeful about the bill's chances. Armstrong pointed out that regulatory clarity is inevitable, whether through the Clarity Act or new rules from the SEC and CFTC.

However, banks remain opposed, particularly due to concerns about stablecoin yields. The American Bankers Association and nearly 80 other banking groups have urged the Senate to bolster the bill's provisions to safeguard community bank deposits and local lending.

With Tuesday's vote looming, the stakes are high. If the bill doesn't pass, lawmakers face a tight deadline to amend and push it through before the current Congress adjourns.
