In a rare clash of property rights and respect for the dead, Telangana High Court has delayed hearing on two petitions from IDBI Bank. Bank wants to move graves on land mortgaged by borrowers who defaulted. Justice B. Vijaysen Reddy led Friday's session,stressing deceased have rights much like living do.
Two plots in Nadergul,Badangpet, Hyderabad,are at center of case . 1,500 and 2,100 square yards each. Bank tried to reclaim properties after borrowers failed to pay up . But graves on land threw wrench in plans.
Bank’s lawyer claimed graves appeared without municipal approval. Cited past Supreme Court and High Court rulings — bodies can be moved,graves relocated if on private land. Suggested borrowers might've worked with locals to place graves there.
Justice Reddy noted emotional weight,acknowledging families' feelings. Must respect these before deciding on grave relocation. Court pushed hearing to July 1,ordering police,municipal authorities to look into bank's concerns . Outcome still hangs in balance…
